Roth Sues VanHalenStore.com
February 17, 2001 -
In a move that is sure to shock fans, David Lee Roth has sued
the web site VanHalenStore.com for violation of the Consumers
Legal Remedies Act. The lawsuit was filed in the Los Angeles
Superior Court on Thursday February 15, 2001.
The suit states that VanHalenStore.com, along with Canelles
Design Group, the Inside, Hostmaster/Datapipe and Hi Speed Posting
"conspired to create a Web site called VanHalenStore.com to use in
the fraudulent sale of purported 'official' Van Halen and Roth
merchandise from the Web site."
Roth's suit also claims that the site "represents that a portion of the
proceeds from the sale of such merchandise is paid to Van Halen
and its members. These representations are false and fraudulent;
Roth, as a former and/or existing member of Van Halen, has never
authorized the sale of 'official merchandise' by VanHalenStore.com
and has never received any royalties or other sums from the sale
of merchandise."
One interesting thing to note is that the suit names Roth as a
"former and/or existing member of Van Halen", whatever that means!
Roth filed a similar lawsuit against his former bodyguard and personal
manager, Ed Anderson on October 29, 1999. Roth's attorney for that
suit, Jeff Benice was quoted at the time as saying:
"The suit was filed as a result of Roth attempting to clean up the
bootlegging and piracy of his image off the Internet."
The outcome of this suit against Anderson remains a mystery.
